User Agreement

  • Kaif is a platform for arranging real-world gatherings. We provide the tools; the people who host and attend gatherings are responsible for what happens at them.
  • You must be at least 16, use the service honestly, and follow the community guidelines. We can suspend accounts that do not.
  • Paid features are optional. Hosts who sell tickets or memberships contract directly with their attendees; we process the payment and take a disclosed commission.
  • You keep ownership of everything you post. You give us the limited licence we need to display it inside the service.
  • Nothing in this agreement removes rights you have under mandatory consumer-protection law where you live.

The summary is a convenience and has no legal effect. Where it and the full text differ, the full text governs.

This User Agreement (the "Agreement") is a legally binding contract between you and Kaif Technologies LLC ("Kaif", "we", "us"), registered at 350000, Russia, Krasnodar Krai, Krasnodar, [street, building, office], OGRN 0000000000000, INN 0000000000. It governs your access to and use of the Kaif mobile applications, this website and all related services (together, the "Service").

By creating an account, or by using the Service in any way, you confirm that you have read this Agreement and agree to be bound by it. If you do not agree, do not use the Service.

1. Definitions

  • "Kaif" (lowercase, in context) means an individual gathering created by a user through the Service.
  • "Host" means the user who creates a Kaif and is responsible for it.
  • "Participant" means a user who joins a Kaif.
  • "Club" means an organisation profile through which a user or group hosts gatherings on a recurring basis, with members, administrators and optional paid offerings.
  • "Radar" means the Kaif Radar feature, which shows approximate positions of nearby users who have chosen to be visible.
  • "Content" means anything you submit, post or transmit through the Service, including text, photographs, messages, statuses and profile information.

2. Eligibility and accounts

You must be at least 16 years old to use the Service. If the law where you live sets a higher minimum age for consenting to the processing of personal data or for entering into contracts online, that higher age applies to you. We do not knowingly permit accounts for people below the applicable minimum age, and we will close any account we identify as belonging to one.

You must register with accurate information and keep it current. You may hold one account. You are responsible for everything that happens under your account, and for keeping your credentials and the device you use secure. Tell us immediately at support@kaif.app if you believe your account has been accessed by someone else.

You may not sell, rent or transfer your account, and you may not allow another person to use it.

3. What the Service is — and is not

Kaif is a venue and a set of tools. We help people find each other and arrange to meet. We are not a party to any gathering, we do not organise gatherings, and we do not supervise, attend, vet or control them.

This is the most important paragraph in this Agreement. Meeting people you do not know carries real risk. We provide safety tools — identity verification, approval controls, blocking, reporting — but they reduce risk; they do not remove it. You decide who you meet and where, and you do so at your own risk.

We do not verify the identity of every user. Identity verification is available to Hosts and is optional; a verified badge means a person submitted a document that a reviewer accepted, and nothing more. It is not a character reference, a background check, or a guarantee of any kind.

We do not guarantee that the Service will be uninterrupted, error-free, or available in your area. We may change, suspend or discontinue any part of it. Where a change materially reduces functionality you have paid for, we will give reasonable notice and, where appropriate, a pro-rata refund.

4. Hosting a gathering

If you create a Kaif, you are its Host. As Host you are responsible for:

  • Describing the gathering accurately, including its location, time, cost, and anything a reasonable person would want to know before deciding to attend.
  • Complying with all laws that apply to what you are organising — including licensing, permits, public-safety, food-safety, noise and accessibility rules where relevant.
  • Having the right to use the venue, and the permission of its owner or operator where required.
  • The safety and conduct of the gathering itself, to the extent within your control.
  • Honouring what you promised. If you cancel, you must tell Participants promptly and refund any amounts collected in accordance with the refund policy you set.

You must not use the Service to host gatherings that are unlawful, that are commercial events disguised as social ones in order to avoid applicable regulation, or that are designed to recruit for, promote or fundraise for any organisation whose activity is restricted by law.

5. Attending a gathering

If you join a Kaif, you agree to attend or to withdraw in good time so the Host can offer your place to someone else. Repeatedly confirming attendance and not appearing may result in restrictions on your account.

Any agreement about attendance, payment or conduct is between you and the Host. We are not a party to it. Where you have paid the Host through the Service, we will assist in resolving a dispute, but we do not underwrite the Host's obligations.

Take the precautions you would take meeting anyone new: meet in a public place first, tell someone where you are going, and leave if you are uncomfortable. Use the report button if something is wrong.

6. Acceptable use

The Community Guidelines form part of this Agreement. In addition, you must not:

  • Impersonate anyone, or misrepresent your age, identity or affiliation.
  • Harass, threaten, stalk, defame or intimidate any person, on or off the Service.
  • Post content that is unlawful, sexually explicit, hateful, or that depicts or promotes violence or self-harm.
  • Use the Service for commercial solicitation, spam, multi-level marketing, or unsolicited advertising.
  • Collect or scrape data about other users, whether manually or by automated means.
  • Attempt to derive another user's precise location from Radar data, or to defeat, reverse or degrade the location-fuzzing described in our Privacy Policy.
  • Circumvent access controls, probe or test the security of the Service, or interfere with its operation.
  • Use automated means to create accounts, join gatherings or send messages.
  • Use the Service to arrange anything unlawful.

Good-faith security research is welcome. If you find a vulnerability, report it to safety@kaif.app before disclosing it, give us reasonable time to fix it, and do not access, modify or retain other users' data. We will not pursue action against researchers who follow this.

7. Your content

You keep all rights you have in your Content. Posting it does not transfer ownership to us.

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for formatting and resizing), and display your Content solely for the purpose of operating, securing and improving the Service, and for the duration you keep it posted. This licence ends when you delete the Content, subject to reasonable backup retention periods and to any copies other users have lawfully retained — a message you sent to a group chat cannot be recalled from the people who received it.

You confirm that you have the rights necessary to grant this licence, and that your Content does not infringe anyone else's rights. If you post photographs of other people, you are responsible for having their permission where the law requires it.

We may remove Content that breaches this Agreement or the Community Guidelines. We are not obliged to monitor Content, and we do not endorse it.

Some features are paid: a Premium subscription, visibility boosts, and the ability for Hosts and Clubs to sell tickets and memberships. Prices, and the commission applicable to sales, are shown before you commit to anything.

Where a Host sells a ticket or membership, the contract for that ticket or membership is between the Host and the buyer. We act as the operator of the payment flow and as the Host's agent for the limited purpose of collecting the amount due. We deduct our disclosed commission and payment-processing costs, and remit the balance to the Host on request through the payout process.

Subscriptions renew automatically for successive periods until cancelled. You may cancel at any time from within the app; cancellation takes effect at the end of the period already paid for. Refunds are governed by the Refund Policy, which forms part of this Agreement.

Hosts receiving payment are responsible for their own tax obligations, including registration, invoicing and reporting where their law requires it. We may be obliged to report payout information to tax authorities and will do so where the law requires.

9. Suspension and termination

You may stop using the Service at any time and delete your account from within the app. Deletion is described in the Privacy Policy.

We may suspend or terminate your access if you breach this Agreement or the Community Guidelines, if your use exposes us or other users to legal risk or harm, or if we are required to by law. Except where immediate action is needed to prevent harm or where notice would be unlawful, we will tell you the reason and give you an opportunity to respond. You can appeal any enforcement decision by writing to safety@kaif.app.

On termination, sections 7 (as to licences already granted for retained copies), 10, 11, 12 and 13 survive.

10. Liability

To the fullest extent permitted by law, we are not liable for: the conduct of any user, whether online or in person; any injury, loss or damage arising at or in connection with a gathering; the accuracy of user-generated content; or any indirect, incidental, special or consequential loss.

Where we are liable, our total aggregate liability arising out of or in connection with this Agreement is limited to the greater of (a) the amounts you paid us in the twelve months before the event giving rise to the claim, and (b) 5,000 RUB or its equivalent.

Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights are unaffected — in the EU that includes rights under Directive 2011/83/EU and (EU) 2019/770; in Russia, rights under the Law "On Protection of Consumer Rights" No. 2300-1.

11. Indemnity

If you use the Service in a business capacity — including as a Club, a venue, or a Host selling tickets — you agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of this Agreement, your Content, or the gatherings you organise. This section does not apply to consumers.

12. Changes to this Agreement

We may amend this Agreement. For material changes we will give at least 14 days' notice in the app or by email before they take effect, and we will update the "effective" date above. If you do not accept a change, stop using the Service and, where you have paid for a period that has not yet elapsed, contact us for a pro-rata refund. Continuing to use the Service after a change takes effect means you accept it.

13. Governing law and disputes

This Agreement is governed by the laws of the Russian Federation, without regard to its conflict-of-laws rules.

If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.

Before starting proceedings, please write to us at hello@kaif.app. Most disputes are resolved faster that way than through a court, and we commit to responding substantively within 30 days.

14. General

  • This Agreement, together with the Privacy Policy, Cookie Policy, Community Guidelines and Refund Policy, is the entire agreement between us about the Service.
  • If any provision is found unenforceable, the rest remains in force and the unenforceable provision is read down to the minimum extent necessary.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign this Agreement. We may assign it to a successor in connection with a merger, acquisition or sale of assets, on notice to you.
  • This Agreement is published in several languages. Where translations differ in meaning, the English version governs, except where the law of your country of residence requires otherwise.
